Who is responsible for your personal data

The party responsible for processing your personal data is Olyvia Labs S.A. de C.V., which operates Trabajo Rapido.

What we mean by personal data and sensitive personal data

In accordance with the Mexican Federal Law on Protection of Personal Data Held by Private Parties, in this notice we understand:

a) Personal data: any information concerning you that allows you to be identified or made identifiable.

b) Sensitive personal data: personal data that affect the most intimate sphere of their holder, or whose misuse may give rise to discrimination or entail a serious risk for them. In particular, data that may reveal racial or ethnic origin, present or future health status, genetic information, religious, philosophical and moral beliefs, trade union affiliation, political opinions and sexual preference are considered sensitive.

What data we collect

We may collect and process your personal data and, where applicable, sensitive personal data, depending on the legal or commercial relationship you have with us and on what we need in order to meet the obligations we have taken on with you.

The processing differs depending on whether you are a client, an employee, someone looking for work through our job board, a candidate, a supplier, or whether you have any other relationship with us. In every case we process your data in line with the principles set out in the applicable law.

Identification and contact data: name, email address, telephone number, profile photograph and the city or area where you look for or offer work.

Employment and professional data: experience, trade or speciality, availability, curriculum vitae and any documents you choose to attach.

Service usage data: listings, applications, messages exchanged inside the platform and ratings.

Payment data: when you buy a paid service, the charge is processed by a specialised third party. We do not store your full card numbers.

How we collect your personal data

We may collect your information in writing, by telephone, or through the various electronic channels we make available to you: the website, the mobile app, social networks and email.

We only collect the data that is essential in order to attend to your employment or hiring needs.

We may also obtain data indirectly when a third party transfers your profile to us with your consent, or from publicly accessible sources permitted by law.

What we use your personal data for

We only use your personal data for the purposes for which it was collected.

Necessary purposes, without which we cannot provide the service:

Creating and administering your account, and verifying your identity.

Publishing and distributing your listings, or showing you other people's listings.

Putting whoever offers work in touch with whoever is looking for it, and enabling the two to communicate.

Processing payments and any applicable refunds.

Answering your questions, complaints and requests, and providing support.

Preventing fraud and misuse, and complying with the legal obligations that apply to us.

Additional purposes, which are not necessary for the service and which you may object to at any time:

Sending you news, benefits and opportunities that may be of interest to you.

Producing aggregate statistics and analysis in order to improve the product.

Where a process requires it, and always with your prior consent, we may apply psychometric, socioeconomic, skills or medical assessments to candidates.

How you can limit the use or disclosure of your data

You can turn off promotional communications from your account settings or from the unsubscribe link included in every email.

You can adjust which information on your profile is visible to other users.

You may also write to us at hi@olyvia.io to ask us to stop using your data for purposes that are not necessary in order to provide the service.

Your ARCO rights and how to exercise them

You have the right to access your personal data, to rectify it when it is inaccurate or incomplete, to cancel it when you consider that it is not required for any of the purposes in this notice, and to object to its processing for specific purposes.

To exercise any of these rights, write to hi@olyvia.io stating: your name and a means of sending you our answer; documents proving your identity or legal representation; a clear description of the data the request concerns; and anything else that helps us locate that data.

We will answer your request within a maximum of twenty working days from the day we receive it, and where the request is well founded we will act on it within the following fifteen working days.

If your request concerns rectification, please also tell us the correction to be made and attach the documentation supporting it.

Withdrawing your consent

You may withdraw the consent you gave us to process your personal data at any time by writing to hi@olyvia.io with the same details required for an ARCO request.

Please note that in some cases withdrawal cannot take effect immediately because a legal obligation requires us to retain certain data, and that withdrawing your consent may mean we can no longer provide the service to you.

You may also delete your account from within the app, or ask us to delete it at the same address.

You can also delete your account and its associated data from the account deletion page, without writing to us.

Transfers of personal data

In order to provide the service we need to share some of your data with third parties. We only transfer your data where we have your express consent, except in the cases the law provides for.

We share data with infrastructure and messaging providers acting on our behalf and under our instructions, with the payment processor when you make a transaction, and with the competent authorities where a legal obligation requires it.

When you publish a listing or apply to one, the profile information you choose to show becomes visible to the other party. That is the very purpose of the service.

Some of these providers are located outside Mexico. In those cases we require them to process your data in accordance with this notice.

Everyone involved in processing your data is bound to do so in accordance with this privacy notice.

How we safeguard your personal data

We have implemented administrative, technical and physical security measures to protect your information against damage, loss, alteration, destruction, or unauthorised use, access or processing.

No security measure is infallible. Should a breach occur that significantly affects your rights, we will inform you so that you can take the appropriate steps.

Confidentiality

Safeguarding your information is of the utmost importance to us. Our staff, related companies, subsidiaries and, where applicable, the third parties involved in processing your data are subject to the confidentiality and accountability obligations set out in this notice.

Use of cookies and similar technologies

Cookies are small text files that a server sends to your device. Session cookies remember the activity you carried out during your visit; persistent cookies save your preferences between visits, which lets us personalise the way we present information to you.

Trackers, or web beacons, are generally images placed on a page that are used to count visitors or to give access to certain cookies. We use them to obtain statistics about which content is of interest. They do not collect information beyond what your browser provides as a standard part of internet browsing.

Through these technologies we collect: pages visited, time spent, IP address, device and browser type, and device identifiers.

We use them to measure audiences, keep your session signed in, understand how the product is used and, where applicable, show you relevant content and advertising.

You can disable or enable cookies from your browser settings, and delete those already stored. If you disable them, parts of the site may stop working correctly.

Some sections may use locally stored objects, such as HTML5 local storage, for purposes similar to those of cookies. These can also be cleared from your browser settings.

We may include links to other websites we consider may be of interest to you. This privacy notice and our obligations regarding the handling of your data apply only to our website and our app, so we are not responsible for the content or the privacy practices of third-party sites.

Changes to this privacy notice

We may amend this notice to reflect changes in the law, in our internal practices or in the service.

Any change will be published on this page, with the date of the last update at the top. Where the change is substantial we will also tell you by email or through a notice inside the app before it takes effect.
